Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Obstacle IQ ("Obstacle IQ", "we", "us", or "our") governing your access to and use of the Obstacle IQ mobile application, website, and related services (collectively, the "Service"). By creating an account, downloading the app, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use Obstacle IQ. If you are under the age of majority in your jurisdiction, you may use the Service only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that the information you provide is accurate and complete.

Use of the Service

Obstacle IQ provides AI-powered feedback on obstacle training, ninja warrior, parkour, OCR, and climbing video footage. You agree to use the Service only for lawful purposes and to upload only footage you have created or have the explicit right to share. You may not use the Service to harass others, infringe intellectual property rights, upload unlawful or harmful content, attempt to reverse engineer the Service, interfere with its operation, or access it through automated means without our written permission.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that pose a risk to other users or to the Service.

Subscription Billing and Renewal

Obstacle IQ offers paid subscription plans billed through the Apple App Store, Google Play, or our web payment processor. Subscription fees, billing intervals, and included features are disclosed at the point of purchase. Payment is charged to your selected payment method at confirmation of purchase.

Subscriptions automatically renew at the end of each billing period at the then-current price unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and turn off auto-renewal at any time through your Apple ID or Google Play account settings, or through your account settings on our website for web subscriptions.

Cancellation Policy

You may cancel your subscription at any time. Cancellations made through the Apple App Store or Google Play must be processed in the respective store's subscription settings; we cannot cancel App Store or Play Store subscriptions on your behalf. Cancellation stops future renewals but does not result in a refund of the current billing period, and you will retain access to paid features until the end of the period you have already paid for.

Refunds for purchases made through the App Store or Google Play are governed by the policies of those platforms. Refund requests for web subscriptions may be directed to support@obstacleiq.com and will be considered in accordance with applicable consumer protection law.

No Medical or Coaching Advice

Obstacle IQ is an educational training tool. The feedback, scores, and drills produced by the Service are generated by automated AI models and are provided for general informational purposes only. The Service does not provide medical advice, diagnosis, or treatment and is not a substitute for qualified coaching, professional supervision, or evaluation by a licensed medical professional. Consult a qualified professional before beginning any training program. You assume all risk associated with physical training and with any action you take based on output from the Service.

Fair Use

Plans that include unlimited analyses are subject to reasonable fair-use limits intended to preserve performance and availability for all athletes. We may rate-limit, throttle, or temporarily suspend access in cases of automated, abusive, or commercially disproportionate use, and will make reasonable efforts to notify affected users.

Intellectual Property

Obstacle IQ, including its software, models, design, branding, text, graphics, and other content provided by us, is owned by Obstacle IQ or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial training use in accordance with these Terms.

You retain ownership of video footage and other content you upload ("User Content"). You grant us a worldwide, royalty-free license to host, store, process, and analyze your User Content solely for the purpose of operating, providing, and improving the Service. We will not sell your User Content or use it for advertising. You are solely responsible for your User Content and represent that you have all rights necessary to grant this license.

Termination

You may stop using the Service and delete your account at any time through the in-app account deletion flow or by contacting support@obstacleiq.com. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if required by law, or if continued provision of the Service to you is no longer commercially reasonable. Upon termination, your right to use the Service ends, and sections of these Terms that by their nature should survive (including Intellectual Property, Limitation of Liability, and Governing Law) will survive.

Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Obstacle IQ and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any injuries, lost profits, lost data, or losses arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the greater of the amount you paid us in the twelve months preceding the claim or fifty US dollars (US$50).

Changes to These Terms

We may update these Terms from time to time to reflect changes to the Service, our business, or applicable law. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice through the app or by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, except where prohibited by applicable consumer protection law in your jurisdiction. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
